Permits can be issued for up to 5 years but the reality is that they are normally issued for shorter periods than this.

Applying for Permits

First of all what category should you apply in?

There are two main categories-

Tier 1 - Intra-Company Transfers, Board Level or Senior Managerial Positions, Inward Investment and also includes shortage occupations - for a full update please ask as these change

Tier 2 - This category of application means that you have to give evidence of your recruitment methods. Most permits will be in this category but not shortage occupations.

TIER 1

Intra-Company Transfers

This is for employees of multinational companies who are transferring to the UK to work. There must be a link between the overseas and the UK company by common ownership.

It is probably one of the most straightforward of application categories but there are pitfalls to avoid. There are important conditions to meet so before you think of bringing an employee to the UK in this category check out the facts with an advisor.

Board Level or Senior Managerial Positions

It's true that these positions with big salaries are on the whole easier to get accepted. You can be reasonably confident that any salary above £50,000 will meet with a more favourable response. You may not need to advertise for the position. You may need to show staff structure or submit a full job description.

Inward Investment

This category of application depends on inward investment of over £250,000 and usually requires a business plan. Specialist help is available to take you through the process.

The Home Office have a new Innovator scheme for those businesses that will bring exceptional economoic benefit to the UK and there is no minimum investment.

TIER 2

This category of application means that you have to give evidence of your recruitment methods. Most permits will be in this category.

The same high level skills are required as for Tier 1.

In Tier 2 applications advertising is usually required to have been undertaken to show that all reasonable steps have been made to recruit from the resident labour force (EEA). Advertising needs to be available across the EEA to be acceptable.

It may be a combination of traditional and web advertising together, that shows the authorities you have made the effort to recruit from the resident labour force. Ask for an update of the latest situation on advertising.

Hotel and Catering workers come under the main work permit scheme.

What will need to be supplied for individuals

As a general rule the following should be supplied:

Copies of academic or professional qualifications. It is only really necessary to send post school qualifications.

References or statements from past employers on ORIGINAL HEADED PAPER showing at least 1 year (for most applications) but 3 years for some with -

Dates - Start and Finish
The job details and title
Outline experience and skills used
A translation in English (if necessary) will be required as well as the original. PLEASE CHECK WITH AN ADVISER AS REFERENCES ARE NOT ALWAYS NEEDED

You don't need to be a huge company to get work permits too. You can have just a handful of employees. You could be starting up your business from scratch. As long as you can produce relevant documents to show the company is trading or will be then you can meet conditions set down.

Training and Work Experience Scheme (TWES)

This type of permit allows candidates to do work based learning. They are usually issued for 6 to 36 months depending on the relevant category. It is the employer who applies. A TWES permit can be issued where the employer has a need for a person to do the following:

- Work based training for a professional or specialist qualification, or
- Work experience.

TWES permits are not issued for sports and entertainment.
